Today His Honour Magistrate Greg Smith handed down his decision in the matter of the Aboriginal Areas Protection Authority v the Northern Territory of Australia. He found against the Aboriginal Areas Protection Authority.
Today’s decision arose from a legal argument on agreed facts concerning the interpretation of conditions of an Authority Certificate as it relates to damage to sacred sites.
The Authority respects the court’s decision which has provided clarity for the Authority on the wording of Authority Certificates, particularly in relation to how works may be conducted on a sacred site.
